En sentencia SL4330-2020 (rad. 83692) del 21 de octubre de 2020 (M.P. Clara Cecilia Dueñas Quevedo), la Sala Laboral de la Corte Suprema de Justicia reiteró su postura jurisprudencial sobre la contratación defraudatoria o intermediación ilegal a través de las EST, la cual se configura cuando se utiliza el servicio a cargo de las EST para ocultar relaciones laborales continuas y por esa vía reducir costos laborales. Señaló que las EST tienen a su cargo la prestación de servicios transitorios en la empresa cliente, en actividades propias o ajenas al giro habitual de la misma por tiempo limitado. También, que no es cierto que las usuarias pueden contratar con las EST cualquier actividad permanente siempre que no exceda el lapso de 1 año; por el contrario, recordó que sólo puede acudirse a esta figura de intermediación laboral para el desarrollo de labores netamente temporales, sean o no del giro ordinario de la empresa, determinadas por circunstancias excepcionales tales como trabajos ocasionales, reemplazos de personal ausente o incrementos en la producción o en los servicios. Igualmente, indicó que "las empresas usuarias no pueden acudir fraudulentamente a esta contratación para suplir requerimientos permanentes. De allí que el artículo 6.º del Decreto 4369 de 2006, les prohíba «prorrogar el contrato ni celebrar uno nuevo con la misma o con diferente Empresa de Servicios Temporales», cuando al finalizar el plazo de 6 meses, prorrogable por otros 6, aún subsistan incrementos en la producción o en los servicios".
